§ 17602.05

Repealed (in Sec. 82) and added by Stats. 2023, Ch. 43, Sec. 83. (AB 120) Effective July 10, 2023. Operative October 1, 2023, by its own provisions.
(a)(1) Upon notification by the Department of Finance, the State Controller shall reduce a county’s allocation pursuant to subdivision (e) of Section 17602 by any realignment withholding amount assessed on the county pursuant to Section 12301.61.
(2)For the fiscal year following the fiscal year in which the county enters into a collective bargaining agreement with the employee organization, the county’s allocation pursuant to subdivision (e) of Section 17602 shall be increased by the amount of the reduction made in the prior fiscal year pursuant to paragraph (1).
(b)The State Controller shall deposit any amounts withheld from counties pursuant to

paragraph (1) of subdivision (a) into the General Growth Subaccount of the Sales Tax Growth Account of the Local Revenue Fund for distribution pursuant to Section 17606.10. The amounts distributed from the General Growth Subaccount pursuant to this subdivision shall be considered one-time deposits and shall not be included in the realignment bases for the Health Subaccount, Mental Health Subaccount, and Child Poverty and Family Supplemental Support Subaccount pursuant to Section 17600.15 in subsequent years.

(c)This section shall become operative on October 1, 2023.
