The sum of twenty-five million dollars ($25,000,000) is hereby transferred from the account to the subaccount for the purposes of implementing this article.

The money in the subaccount, upon appropriation by the Legislature to the department, may be used by the department for both of the following:
clearance, flood mitigation, and cleanup activities.

Notwithstanding any other provision of law, regulations set forth in Chapter 2.4 (commencing with Section 451.1) of Division 2 of Title 23 of the California Code of Regulations that are in effect on March 8, 2000, may be used to carry out this article.
