Added by Stats. 2023, Ch. 697, Sec. 4. (SB 40) Effective January 1, 2024.
(a)The State Bar of California shall require that all employees and prospective employees, and may require volunteers, contractors, and subcontractors, to submit fingerprints to the Department of Justice and to the Federal Bureau of Investigation in order to establish identity and to determine whether the individual has a record of criminal conviction in this state or in other states, including through a national criminal history check.
(b)The State Bar shall submit to the Department of Justice fingerprint images and related information required by the Department of Justice for all employees, prospective employees, volunteers, contractors, and subcontractors, pursuant to subdivision (u) of Section 11105 of the Penal Code. The Department of
Justice shall provide a state or federal level response pursuant to subdivision (p) of Section 11105 of the Penal Code.
