§ 65650.5

(a)A person aggrieved by an action of the commission may file a grievance with the commission or a duly authorized committee of the commission designated for that purpose. An appeal from a decision of the commission may be made to the secretary. The secretary shall review the record of the proceedings before the commission. If the secretary finds that the record shows by substantial evidence that the commission’s action was not an abuse of discretion or illegal, the secretary shall dismiss the appeal.
(b)If the secretary finds that the action is not substantially sustained by the record, was an abuse of discretion, or illegal, the secretary may reverse the action of the commission.
(c)A decision

of the secretary is subject to judicial review upon petition of the commission or any party aggrieved by the decision.
